Tariff refund acts of 2026: what is proposed, what is law, and what would change

Searches for a "tariff refund act" come from two different hopes: consumers hoping for a check, and importers wondering whether Congress will change the refund process. Neither has happened: taxpayers.net says of the bills that it tracks, "None has passed either chamber, been signed, or been funded" (status as of October 4, 2026).

The "$2,000 tariff dividend" began as a November 2025 social-media post by the President and was never introduced as a bill; its revenue base, the IEEPA tariffs, was struck down in February 2026 (taxpayers.net, status as of October 4, 2026; reported).
What is law
- The Supreme Court's ruling of February 20, 2026 and CBP's CAPE process, which refunds the importer of record with interest. This required no legislation; it follows from the duties having been unlawful.
- The statutes that govern the edges: 19 U.S.C. § 1514 (protests within 180 days of liquidation), 28 U.S.C. § 2636(i) (two years for § 1581(i) suits), 19 U.S.C. § 1505(c) and 19 CFR 24.36 (interest).
What would change if a bill passed
A consumer rebate would be a separate program — payments from the Treasury to households on whatever terms the bill sets. taxpayers.net (status as of October 4, 2026) says of the importer refunds and the consumer rebate bills: "The two things are legally unrelated." S. 3905 is a bill of another kind: its full title speaks of the refund of the IEEPA duties themselves. We read its title and its status on govinfo (October 9, 2026), not its text.
